Operating in Canada: Dos and Don'ts for Employers in 2007
Presented by Brian Smeenk, Earl Phillips, and Marc Benoit
December 5, 2006

Even though the live seminar on this topic has already taken place, you can still hear it! For your convenience, we've recorded it on CD, so you can listen when you have time or share it with colleagues in your organization.

Operating in Canada: Dos and Don'ts for Employers in 2007

If you operate in, or employ a workforce in Canada, don't miss this essential 90-minute audio conference on the increasing liability your company faces in 2007. Your conference leaders, all experienced Canadian employment law attorneys, will help explain recent and forthcoming changes in employment statutes, including:

  • Mandatory retirement policies are now illegal in several provinces.
    Quebec now prohibits "psychological harassment" of employees. Such laws significantly expand the meaning of harassment beyond what U.S. employers are accustomed to tackling.
  • Severance pay is now required all across the country even when employees become totally disabled.
  • There is strong legislation protecting whistleblowers, including federal criminal sanctions for taking actions against them.
  • Privacy laws recently have been expanded across Canada, especially under federal law and in the provinces of British Columbia and Alberta. Quebec has long had strong privacy laws affecting employers.

You'll also learn how new developments in case law are affecting employers. Recent cases have:

  • Increased employer liability for "hardball tactics" or "bad faith" when terminating employees;
  • Set new high-water marks for punitive damages in wrongful dismissal cases;
  • Allowed defamation claims to be joined with wrongful dismissal claims;
    Increased the use of class actions to pursue employment claims.

Make no mistake, employment law is changing in Canada faster than ever. And if you don't stay on top of it, you face a host of compliance headaches, including:

  • The legal framework of Canada and its provinces
  • Canadian employment statutes and what they cover
  • Non-union employee rights, including wrongful dismissal claims and damages for "bad-faith" terminations.
  • Harassment -- sexual and "psychological" harassment, a term not used in American law
  • How union organizing laws in Canada are more prounion than in the United States. Also, what happens to unions when businesses are bought and sold.
  • Government-sponsored insurance programs, for health, disability insurance, workers' compensation, and unemployment
  • And more, all in just 90 information-packed minutes!

If your Canadian managers haven't informed you of these and other issues, and advised you appropriate policy revisions, you're operating on dangerous ground. Don't ignore the rapid changes taking place all across Canada -- take a proactive step to protect your company from them. Listen to Operating in Canada: Dos and Don'ts for Employers in 2007.
